    KEDUDUKAN DAN HAK ANAK LUAR KAWIN DALAM MEWARIS BERDASARKAN PERSPEKTIF HUKUM ADAT

    Tujuan penelitian ini untuk mengetahui bagaimanakah  kedudukan dan hak anak luar kawin dalam mewaris menurut BW  dan bagaimanakah kedudukan dan hak anak luar kawin dalam mewaris berdasarkan perspektif hukum adat yang dengan metode penelitian hukum normatif disimpulkan: 1. KUHPerdata mengakui keberadaan anak di luar kawin untuk mendapatkan harta warisan dari pewaris sepanjang telah diakui secara sah menurut undang-undang, sedangkan di dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan hanya mengakui yang dimaksud dengan anak yang sah adalah anak yang dilahirkan dalam atau sebagai akibat perkawinan yang sah. Kemudian di dalam Pasal 43 ayat 1 menyatakan bahwa anak yang dilahirkan di luar perkawinan hanya mempunyai hubungan perdata dengan ibunya dan keluarga ibunya. Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 tentang pengujian Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan terhadap Undang-Undang Dasar Negara Republik Indonesia 1945 dalam amar putusan telah merubah makna Pasal 43 ayat 1 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, sebagai berikut : “ Anak yang dilahirkan di luar perkawinan mempunyai hubungan perdata dengan ibunya dan keluarga ibunya serta dengan laki-laki sebagai ayahnya yang dapat dibuktikan berdasarkan ilmu pengetahuan dan teknologi dan/atau alat bukti lain menurut hukum mempunyai hubungan darah, termasuk hubungan perdata dengan keluarga ayahnya”. 2. Kedudukan anak luar kawin dapat dilihat dari ketiga sistem kekerabatan yang    ada, yaitu: a. Masyarakat Patrilinial, Kedudukan anak luar kawin hanya mempunyai hubungan kekerabatan dengan ibunya saja dan menjadi ahli waris dari kerabat ibunya.Oleh karena itu, anak luar kawin bukan sebagai ahli waris dari bapaknya (biologis), b. Pada masyarakat matrilineal, hubungan kekerabatan baik antara bapak biologisnya  dengan anak luar kawin dengan keluarga bapak biologisnya cukup pada pengakuan dengan menikahi ibu anak tersebut, karena masyarakat ju ga tidak menganggap motivasi menghindari malapetaka, sehingga melahirkan anak luar kawin tersebut sebagai perbuatan yang harus dicela.c. Pada masyarakat parental atau bilateral di daerah Jawa anak yang lahir di luar perkawinan dinamakan anak kowar, dimana ia hanya mewaris dari ibunya atau keluarga ibunya.Kata kunci: anak luar kawin

    Submillimetre dust polarisation and opacity in the HD163296 protoplanetary ring system

    We present ALMA images of the sub-mm continuum polarisation and spectral index of the protoplanetary ringed disk HD163296. The polarisation fraction at 870{\mu}m is measured to be ~0.9% in the central core and generally increases with radius along the disk major axis. It peaks in the gaps between the dust rings, and the largest value (~4%) is found between rings 1 and 2. The polarisation vectors are aligned with the disk minor axis in the central core, but become more azimuthal in the gaps, twisting by up to +/-9degrees in the gap between rings 1 and 2. These general characteristics are consistent with a model of self-scattered radiation in the ringed structure, without requiring an additional dust alignment mechanism. The 870/1300{\mu}m dust spectral index exhibits minima in the centre and the inner rings, suggesting these regions have high optical depths. However, further refinement of the dust or the disk model at higher resolution is needed to reproduce simultaneously the observed degree of polarisation and the low spectral index.Comment: 5 pages +2 pages supplemental data. v2 - revised figures and final values; conclusions unchange

    High resolution observations of the outer disk around T Cha: the view from ALMA

    T Cha is a young star surrounded by a transitional disk with signatures of planet formation. We have obtained high-resolution and high-sensitivity ALMA observations of T Cha in the CO(3{\rm CO}(3--2)2), 13CO(3{\rm ^{13}CO}(3--2)2), and CS(7{\rm CS}(7--6)6) emission lines to reveal the spatial distribution of the gaseous disk around the star. In order to study the dust within the disk we have also obtained continuum images at 850μ\mum from the line-free channels. We have spatially resolved the outer disk around T Cha. Using the CO(3-2) emission we derive a radius of \sim230 AU. We also report the detection of the 13^{13}CO(3-2) and the CS(7-8) molecular emissions, which show smaller radii than the CO(3-2) detection. The continuum observations at 850μ\mum allow the spatial resolution of the dusty disk, which shows two emission bumps separated by \sim40AU, consistent with the presence of a dust gap in the inner regions of the disk, and an outer radius of \sim80AU. Therefore, T Cha is surrounded by a compact dusty disk and a larger and more diffuse gaseous disk, as previously observed in other young stars. The continuum intensity profiles are different at both sides of the disk suggesting possible dust asymmetries. We derive an inclination of i(deg)=67±\pm5, and a position angle of PA (deg)= 113±\pm6, for both the gas and dust disks. The comparison of the ALMA data with radiative transfer models shows that the gas and dust components can only be simultaneously reproduced when we include a tapered edge prescription for the surface density profile. The best model suggests that most of the disk mass is placed within a radius of R<R< 50AU. Finally, we derive a dynamical mass for the central object of MM_{*}=1.5±\pm0.2M_{\odot}, comparable to the one estimated with evolutionary models for an age of \sim10Myr.Comment: 5 pages, 5 figures, accepted for publication in A&A Letter

    VLA Observations of the Infrared Dark Cloud G19.30+0.07

    We present Very Large Array observations of ammonia (NH3) (1,1), (2,2), and CCS (2_1-1_0) emission toward the Infrared Dark Cloud (IRDC) G19.30+0.07 at ~22GHz. The NH3 emission closely follows the 8 micron extinction. The NH3 (1,1) and (2,2) lines provide diagnostics of the temperature and density structure within the IRDC, with typical rotation temperatures of ~10 to 20K and NH3 column densities of ~10^15 cm^-2. The estimated total mass of G19.30+0.07 is ~1130 Msun. The cloud comprises four compact NH3 clumps of mass ~30 to 160 Msun. Two coincide with 24 micron emission, indicating heating by protostars, and show evidence of outflow in the NH3 emission. We report a water maser associated with a third clump; the fourth clump is apparently starless. A non-detection of 8.4GHz emission suggests that the IRDC contains no bright HII regions, and places a limit on the spectral type of an embedded ZAMS star to early-B or later. From the NH3 emission we find G19.30+0.07 is composed of three distinct velocity components, or "subclouds." One velocity component contains the two 24 micron sources and the starless clump, another contains the clump with the water maser, while the third velocity component is diffuse, with no significant high-density peaks. The spatial distribution of NH3 and CCS emission from G19.30+0.07 is highly anti-correlated, with the NH3 predominantly in the high-density clumps, and the CCS tracing lower-density envelopes around those clumps. This spatial distribution is consistent with theories of evolution for chemically young low-mass cores, in which CCS has not yet been processed to other species and/or depleted in high-density regions.Comment: 29 pages, 9 figures, accepted for publication by ApJ.     Three Li-rich K giants: IRAS 12327-6523, IRAS 13539-4153, and IRAS 17596-3952

    We report on spectroscopic analyses of three K giants previously suggested to be Li-rich: IRAS 12327-6523, IRAS 13539-4153, and IRAS 17596-3952. High-resolution optical spectra and the LTE model atmospheres are used to derive the stellar parameters: (TeffT_{\rm eff}, log gg, [Fe/H]), elemental abundances, and the isotopic ratio 12^{12}C/13^{13}C. IRAS 13539-4153 shows an extremely high Li abundance of logϵ\log\epsilon(Li) \approx 4.2, a value ten times more than the present Li abundance in the local interstellar medium. This is the third highest Li abundance yet reported for a K giant. IRAS 12327-6523 shows a Li abundances of logϵ\log\epsilon(Li)\approx 1.4. IRAS 17596-3952 is a rapidly rotating (VsiniV{\sin i} \approx 35 km s1^{-1}) K giant with logϵ\log\epsilon(Li) \approx 2.2. Infrared photometry which shows the presence of an IR excess suggesting mass-loss.     Model of Culture for Innovation

    In the current economic panorama, innovation is considered to be an important source of sustainable competitive advantage. The literature indicates that organizational culture is one of the most important factors in innovation stimulation, given that influencing employee behavior promotes the acceptance of innovation as a fundamental organizational value and employee commitment to it. As such, organizations should concentrate on promoting an innovative culture that permits the institutionalization of innovation, which may occur by way of planned action or by means controlled by leaders or indirect mechanisms, such as structures, procedures, or institutional policy declarations. The importance of an innovative culture model which serves as a basis for cultural transformation emerges therefrom. Previous investigations have addressed innovative culture models focused on cultural traits and/or cultural determinants. The present study offers a holistic innovative culture model that in addition to addressing cultural traits and their determinants, as is done in other models, and takes into account management competencies and organizational capacities that are required to conform to cultural traits, to achieve innovative behavior on the part of the individuals of the organization

    Revealing the role of past and current climate in shaping the distribution of two parapatric European bats, Myotis daubentonii and M. capaccinii

    In this contribution, we aim at determining the role of climate in shaping the current and historical (Last Glacial Maximum and Middle Holocene) distributions of two parapatric bat species (Myotis daubentonii and Myotis capaccinii) in Europe, using ensemble Habitat Suitability Modelling (HSM). Model projection to current climatic conditions predicted distributions largely coherent with the ones observed for the two species in the study area. Temperature- and precipitation-linked variables well accounted for the observed parapatry of the two target species. Moreover, areas of co-occurrence turned out to be those where the main ecological needs concerning the most important range-limiting variables are met for both species. Model projections to past scenarios allowed us to hypothesize the effects of climatic oscillations over the distribution of the two species during the Late Pleistocene and Holocene. Extreme range contractions during the Last Glacial Maximum and the subsequent expansions during Middle Holocene were predicted, consistently with general patterns of post-glacial recolonization routes of many temperate bat species in Europe. Our findings are largely coherent with recent phylogeographic studies investigating the two target species, thus corroborating the validity of potential distribution scenarios obtained from the models and, more importantly, confirming the great influence that glacial cycles had in shaping the biogeography of the European fauna

    A new analysis of the WASP-3 system: no evidence for an additional companion

    In this work we investigate the problem concerning the presence of additional bodies gravitationally bounded with the WASP-3 system. We present eight new transits of this planet and analyse all the photometric and radial velocity data published so far. We did not observe significant periodicities in the Fourier spectrum of the observed minus calculated (O-C) transit timing and radial velocity diagrams (the highest peak having false-alarm probabilities of 56 per cent and 31 per cent, respectively) or long-term trends. Combining all the available information, we conclude that the radial velocity and transit timing techniques exclude, at 99 per cent confidence limit, any perturber more massive than M \gtrsim 100 M_Earth with periods up to 10 times the period of the inner planet. We also investigate the possible presence of an exomoon on this system and determined that considering the scatter of the O-C transit timing residuals a coplanar exomoon would likely produce detectable transits. This hypothesis is however apparently ruled out by observations conducted by other researchers. In case the orbit of the moon is not coplanar the accuracy of our transit timing and transit duration measurements prevents any significant statement. Interestingly, on the basis of our reanalysis of SOPHIE data we noted that WASP-3 passed from a less active (log R'_hk=-4.95) to a more active (log R'_hk=-4.8) state during the 3 yr monitoring period spanned by the observations. Despite no clear spot crossing has been reported for this system, this analysis claims for a more intensive monitoring of the activity level of this star in order to understand its impact on photometric and radial velocity measurements.Comment: MNRAS accepted (14/08/2012
